Professor Files Copyright Infringement Lawsuit Against Unnamed Students Because Portions of his Exams Were Found OnlineYikes. I’d take a bad grade over a lawsuit any day.Chapman University Assistant Professor David A. Berkovitz is suing some of his students for copyright infringement after finding some portions of his exams on Course Hero, a website used for accessing and sharing study resources. The professor found some parts of the midterm and final exams for his spring 2021 business course on the platform, much to his surprise and dismay. Hoping to hold the students responsible for the leaks accountable for their actions, Berkovitz submitted his copyright applications for the said tests. After gaining the copyright registrations in February 2022, the professor then filed a lawsuit. The suit alleges the defendants infringed on his exclusive right to reproduce, make copies, distribute, or create derivative works when the exams were published without his permission. According to KTLA, Berkovits is requesting an order of “impoundment on all devices that hold copies of the copyrighted exams within the defendants’ possession, custody, and control.” Aside from the devices, the professor has also requested an award of the following: actual damages and profits, statutory damages for willful infringement,  attorneys’ fees, prejudgment interest; costs of the suit, and other additional fees.image credit: Chapman University #lawsuit #ChapmanUniversity #copyright #copyrightinfringement #examleaks #CourseHero
